Recent changes to section 52 of the Copyright, Designs and Patents Act have made libraries more responsible for ensuring all items and props in an image are not subject to copyright and do not require clearance.

We advise that all BAPLA members and professionals working in this industry have professional indemnity insurance, which offers vital protection when you hold large collections of images for which clearances might be required.

If you have any employees, it is compulsory in the UK to have employers’ liability. Even if you employ an extra pair of hands for a short period of time, such as assistants, you should always maintain employers’ liability.

Typically, we also suggest you consider cyber insurance to protect from hacker attacks, and if you have an office, you’ll probably need to insure your spaces and equipment too.

Most photographers and artists are self-employed individuals and therefore should typically have their own insurances, such as equipment insurance and public liability. If, however, you directly employ artists and photographers, then typically they would be covered under your insurances.

This can be quite complicated and we are here to help!

For example, if your agency is supply only. You simply supply an artist who is self-employed, and do not attend the shoot. That artist is not under your direction or supervision, so it would be difficult for you to be held responsible for anything that goes wrong, and arguably that self-employed individual should have their own insurances.

On the other hand, if you are running a shoot from top to bottom, then most individuals on the shoot will be under your direction and supervision. In that case if something is damaged or someone is injured, it’s likely you will be responsible and the buck will stop with you

Can you cover cars on public roads?

No, our vehicle extensions are intended to cover damage to vehicles as props whilst being work on, off road or within the confines of a studio. Any cars being driven on public roads must that car insurance, which is prescribed under the Road Traffic Road. The vehicles must show as insured on the Motor Insurance Database. The intention of our policy is to cover damage to the vehicles on set or off road (off public roads) when being used on a prop.

You may also want to insure your equipment, such as laptops and tablets (or cameras if you have those too?). And if you have you own props, and wardrobe, we can also insure that those. And finally, hired in props, they can also be added to your package.

Some of my equipment is hired, some is borrowed and some is owned by me, will it all be covered?

Accepted Answer

Yes, we can insure hired equipment on the same basis as your own equipment.

Typically, when hiring equipment from a hire company, you are responsible for insuring said equipment. That insurance must include 13 weeks ‘Loss of Hire’ cover, which compensates the hire company for lost income should the equipment be unavailable for hire due to loss or damage whilst in your possession.

Some hire companies may offer their own insurance (although this can be expensive) but the majority don’t so it will be your responsibility to secure insurance.

We advise that you insure any borrowed equipment along with your own owned equipment, particularly if borrowing it for an extended length of time. Read more about insuring hired equipment here.

These include breaches of infringement of intellectual property rights including copyright infringement, or any misappropriation of musical compositions, graphic material, or artwork.

It’s very easy for a third party to bring an allegation of negligence or breach of intellectual property, even if the grounds for doing so are unfounded. Employers’ liability will protect you from legal costs should an employee sustain a bodily injury in the course of their employment.

You will need to take out Employers Liability if you have an employee. The creative industry is unique, in terms of the prevalence of freelancers. We are very cautious when it comes to employers’ liability. If you employ an extra pair of hands for a short period of time, such as assistants, we would highly recommend that you always maintain employers’ liability. Freelancers would then be covered in the same ways as employees whilst working under your supervision and control.
